General Notary Work (GNW) encompasses a wide range of tasks that involve verifying the authenticity of signed documents and administering oaths. Notaries public are appointed by each state's government, typically under the oversight of the Office of Secretary of State, to perform these duties, ensuring the integrity and legal validity of various documents.
The institution of the notary public dates back to ancient Rome, where scribes were appointed by the government to witness and authenticate legal documents. This practice spread throughout Europe and eventually made its way to the United States, where the role of the notary public became firmly established during the colonial era.
Today, notaries public perform a variety of essential tasks, including vehicle title transfers, address affidavits, contracts, and other forms of agreements. In North Carolina vehicle title transfers, notaries verify the identity of the seller and require the name and address of buyer to be written on the title, ensuring that the transfer of ownership is legal and valid but only requiring the seller's appearance and satisfactory identification. Address affidavits are used to certify a person's current address, often required for various legal or administrative purposes, including for students in public and private schools. Notaries also witness and authenticate contracts, ensuring that all parties involved have agreed to the terms and conditions. Additionally, notaries may be involved in verifying the authenticity of documents such as wills, powers of attorney, and oaths, through witnessing the principal and witness signatures.
Notaries are not allowed to provide legal advice or accept payment for legal services, as the office alone is not one allowed to practice law (some attorneys are notaries public however). Therefore, a notary may not choose or tell a signer which notarial certificate should be used. That is up to the signer to decide.
